TERMS OF SALES

Planet'Glace is the registered trademark of SAS Marianne export.
The general conditions of sale described below are intended to govern all contractual relations between SARL MARIANNE EXPORT with a capital of 100,000 € whose head office is located: 30 Chemin du Halop, F 33770 Salles - RCS 402 191 142 and Customers wishing to use the service set up by MARIANNE EXPORT on the World Wide Web in order to make purchases there.
The Customers and MARIANNE EXPORT adhere to it without reserve and the fact
to send an order to MARIANNE EXPORT by using this service will be valid for the Customer manifestation of this membership.
These general conditions of sale may be modified at any time by MARIANNE EXPORT, which is why we invite Customers to read them carefully before each purchase.
The photos and descriptions of the products presented on this site have no contractual value.
Finally, our services are reserved for persons legally capable of entering into contracts under French law. If you do not meet these conditions, you should not use this service.

Article 2: Order
After selecting your products and identifying yourself, you will choose your method of payment (by credit card in secure payment, by check, SWIFT or WESTERN UNION transfer).
You must fill in all the mandatory fields specified on the electronic form.
An order number will be assigned to you. The mere delivery of this number will not constitute acceptance of the order, our commitment only being final after confirmation from our Banking Institution in the event of payment by credit card or from receipt of payment in the event of payment by bank check. , SWIFT transfer or WESTERN UNION.
In the event that our Banking Institution refuses to validate the payment by credit card or in the event of non-receipt of a check or a transfer within eight days of the order, this will be canceled by computer and you will be notified by E-mail .
Upon receipt or acceptance of your payment, the procedure for shipping your order is launched.

Article 3: Price
The prices indicated are exclusive of tax (excluding taxes).
For electrical or electronic equipment, product prices include the cost of disposal of waste electrical and electronic equipment in accordance with the regulations in force.
For the products presented on the site and sold online: the prices indicated are exclusively valid for orders placed on the site.
For the products presented on the site and not sold online but sold by special order: the prices are given for information only. They may vary depending on supplies.
As such, we invite you to contact our sales department directly. Unless otherwise indicated, the prices indicated do not include shipping or delivery costs and in particular the cost of transport.

Article 4: Payment
You can pay for your purchases by credit card (secure payment), by bank or postal check or by Swift transfer.
Payment by credit card: All the data entered is
immediately encrypted. This information is only known to the computers of our Banking Establishment to get in touch with the customer's bank. At no time can Marianne Export or anyone on the web view your card number. Customer payments are banked upon acceptance of the order by Marianne Export. In the event of a shortage of stock or the impossibility of respecting the delivery times stipulated on the order form, Marianne Export will not cash the payment and the credit card will not be debited.
Payment by bank or postal check: Send your duly completed check for the amount of your order made out to SARL Marianne Export and signed to the following address: (The customer will recall the order number.)

An invoice will be attached to your package or will be sent to you separately.
Payment by SWIFT or WESTERN UNION transfer: Please contact us for payment by SWIFT or WESTERN UNION transfer.

Article 5: Deliveries
All products on the site are available and our offers are offered within the limits of available stocks. In case of unavailability of a product after placing your order, we will inform you by e-mail or by telephone within 24 hours (working days).
You can then request the cancellation of your order or
the exchange of the missing product(s).
Depending on the nature and weight of your package, La Poste, Chronopost or a private carrier will deliver your order within the time indicated on your order summary.
Delivery means in your mailbox, in front of your house or at the foot of your building. In case of absence, a calling card will be delivered to your mailbox.
The delivery times indicated are exclusive of weekends and public holidays.
The delivery period runs from the day after the order date in the case of payment by credit card, subject to acceptance of the latter or upon receipt of the check in the case of payment by check. In the case of an order for products with different delivery times, the entire order will be delivered on the basis of the longest time.
We make every effort to ensure that the products ordered are delivered to you on time. In the event of an extension of the delivery time beyond our control, we undertake to notify you as soon as possible in order to allow you to decide whether to maintain or cancel your order in whole or in part.
On the day of delivery, you must sign a delivery note attesting to the receipt of compliant goods. In the event of a complaint, refer to Article 6 for the procedure to follow.

Article 6: Conformity of the goods.
Upon receipt of the goods, you must carefully check the package(s) and check the contents in the presence of the delivery person before signing the delivery note.
If the products delivered have suffered damage during transport and are damaged (breakage, shock, deformation, etc.) or do not comply with the specifications indicated on your order form (error on the product, color, etc.), you must refuse the parcel(s) by clearly writing the reason for your refusal on the delivery note. The package(s) will be returned to us and delivered to you again at no additional cost.
If the delivery does not comply with the delivery note, fill in the delivery note by legibly entering your reservations in a precise and detailed manner. Note precisely the number of packages and the description of the missing or non-compliant products before signing the slip. Confirm the missing products using the contact form, section "contact us", by recalling the details of your order or by telephone at the number indicated on your order confirmation email. In the absence of specific reservations on the delivery note, the goods will be considered as delivered in conformity.

Article 7: Conditions and Cost of delivery.
We deliver in Metropolitan France, Corsica, overseas departments and territories as well as internationally.
The net prices are communicated to you on your summary of
ordered.
The delivery costs vary according to the type of order (amount, nature, volume) and are indicated to you before you proceed to the validation of your order.
Metropolitan France: Our shipments are free of charge from 450€ of purchase excluding tax.
DOM-TOM and International: Our sales are usually made ex-works, i.e. Ex-Works Loaded (Incoterms ICC 2000).

Article 8: Duties and taxes, customs
A - VAT
The regulations are set by the European Union.
Shipping to a country in the European Union:
Individuals: French VAT invoice included.
Company with an intra-community VAT number:
tax-free billing.
Shipping outside the European Union: Invoicing exempt from taxes and duties (any duties at destination are the responsibility of the customer).
B - CUSTOMS DUTIES AT DESTINATION AND LIMITATIONS
IMPORT
Any customs duties to be paid at destination are the responsibility of the recipient. These rights do not come under the responsibility of Marianne Export.
Also, it is up to you to inform yourself with the local authorities of any import restrictions for the products you plan to order.

Article 9: Products under warranty.
For products benefiting from a guarantee, the Manufacturer's guarantee applies exclusively. Our responsibility cannot be engaged.

Article 10: Time limits for withdrawal.
You have a statutory withdrawal period of fourteen (14) working days from receipt of your order.
In this case, you must first contact us by email:

Return the product(s) to us along with the invoice and we will reimburse you (if the request is made within the legal withdrawal period).
In all cases, return shipping costs are your responsibility.
The product(s) must be in its (their) original packaging, accompanied by all the accessories and instructions, and be in perfect condition.
We will not accept return postage due, nor those that are not accompanied by the invoice. If the item was delivered to you by a carrier, contact us by e-mail, we will tell you what to do.

Article 11: Use of collected data.
The data communicated by our customers and visitors to the site are subject to computer processing by Marianne Export. They are used to process your request or your order and to get to know you better in order to adapt our offer to your needs. They are intended for Marianne Export and its service providers for the execution of contracts and requests.

Article 12: Reservations of title.
It is agreed that the goods delivered and invoiced to the customer remain the property of SARL Marianne Export until full payment of their price, in application of law n ° 80-335 of May 12, 1980 and articles 115 paragraphs 2 and 122 of law n°85-98 of January 25, 1985.
Sales are therefore concluded with retention of title and the transfer of this property only occurs after full payment of the price. Failure to pay may result in a claim for the goods. Eventually, a lump sum indemnity will be collected for recovery costs in the event of late payment.
The above provisions do not preclude, from the time of delivery, the transfer to the buyer of the risks of loss or deterioration.

Article 13: Exemption from liability.
We cannot be held responsible for any breach of our obligations under these general conditions of sale resulting from facts beyond our control and/or resulting from a case of force majeure recognized as such by the French Courts and Tribunals. .

Article 14: Law and Competent Court.
As soon as you consult our site, for any reason whatsoever, you accept that any dispute arising as a result of this consultation is the sole jurisdiction of the courts within the jurisdiction of BORDEAUX.
These general conditions of sale and use are governed for all of their stipulations by French law.
In the absence of an amicable agreement between the parties, any dispute that may arise between them as to the formation, execution or interpretation will be the sole jurisdiction of the courts within the jurisdiction of BORDEAUX.
